This Notice explains how Sleep Management, LLC d/b/a Viemed, Inc. (“VieMed”), parent company of Lehan Drugs, Inc., who owns and operates this breastpumpstore.com website business, and all current and future affiliated entities, and subsidiaries, of VieMed (“we,” “us,” or “our”) may use and disclose your Protected Health Information (“PHI”) in compliance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and sets forth your authorization for such use.
By agreeing to this Policy, and placing an order through this Website, you authorize an assignment of insurance benefits to VieMed in any state where Lehan Drugs, Inc. is not licensed or does not have an agreement to distribute durable medical equipment, and you acknowledge your financial responsibility for any amounts not covered by insurance.
- Uses and Disclosures of PHI
We may use or disclose your PHI, as minimally necessary, for the following purposes without additional authorization:
- Treatment: To coordinate and manage your healthcare, such as communicating with your physician regarding prescriptions or medical equipment.
- Payment: To verify insurance benefits, submit claims, obtain payment, and perform related billing activities.
- Healthcare Operations: For quality assessment, compliance reviews, training, accreditation, and business management.
We may also contact you regarding deliveries, refills, health-related services, or alternative treatment options.
Certain uses and disclosures are permitted by law without your authorization, including for public health purposes, legal proceedings, health oversight activities, and worker’s compensation.
Any other use or disclosure of your PHI will require your written authorization, which you may revoke as described in Section 4.
- Your Rights
You have the right to:
- Access and obtain a copy of your PHI.
- Request amendments to your PHI.
- Request restrictions on certain uses or disclosures (though we are not always required to agree).
- Request confidential communications through alternative means or at alternative locations.
- Receive an accounting of certain disclosures.
- Receive a paper copy of this Notice at any time.
- Revocation of Authorization
You may revoke this authorization in writing at any time by contacting our Compliance Officer, whose contact information is located below. Revocation will not affect any actions taken before the date it is received.
- Safeguards
We maintain administrative, technical, and physical safeguards to protect your PHI in both paper and electronic formats. While we employ reasonable measures to secure your information, no method of transmission or storage is completely secure.
- Breach Notification
In the event of a breach of unsecured PHI, we will notify you promptly as required by law and will take steps to mitigate any potential harm.
- Assignment of Benefits
By accepting products or services from us, you:
- Authorize the release of medical or other information necessary to process claims and verify coverage.
- Assign and authorize direct payment to us of all insurance benefits, including Medicare and Medicaid, for products or services provided.
- Agree to forward to us promptly any insurance payments you receive directly for covered services.
- Financial Responsibility
You acknowledge and accept responsibility for all charges not covered by insurance, including but not limited to deductibles, co-payments, coinsurance, non-covered items, and equipment not authorized by your plan.
